Our Services

4.1 Organisation of Expeditions

We organise Expeditions, design itineraries, and coordinate logistics together with qualified Guides and local partners.

4.2 Information and Advice

The Website provides general information about Expeditions. More detailed or personalised advice (e.g. suitability, level, preparation) may be given by e-mail, phone or direct communication.

4.3 Third-Party Services

Some components of an Expedition (accommodation, transport, porters, permits, extra activities) may be provided by independent third-party suppliers under their own terms. We are not responsible for their separate contractual relationships with you, except as required by applicable law.

4.4 Availability

The inclusion of an Expedition or date on the Website does not guarantee availability. All Bookings are subject to written confirmation from the Company.

Section 05

Use of the Website

You must be at least 18 years old and have the legal capacity to enter into binding contracts in order to make a Booking. You agree to provide information that is true, accurate, current and complete.

You must not misuse the Website, including by:

  • Attempting to gain unauthorised access to the Website, servers or data.
  • Using the Website for fraudulent, illegal or abusive purposes.
  • Copying, scraping or extracting content for commercial purposes without prior written consent.

We may suspend or terminate your access if we reasonably believe you are in breach of these Terms.

Section 06

Bookings and Contract Formation

6.1 Request and Quote

To book an Expedition, submit a request via the Website form, e-mail or any method made available. We will provide a quote including:

  • Itinerary and main features
  • Tour Price and applicable fees
  • Payment terms and deadlines
  • Key conditions (group size, altitude, prerequisites)

6.2 Confirmation and Deposit

Your Booking is confirmed only when all three of the following have occurred:

  1. 1You have accepted the quote in writing.
  2. 2You have paid the required deposit or full Tour Price.
  3. 3We have issued written confirmation of your Booking.
Until confirmation is issued, availability, pricing, Guides and dates cannot be guaranteed.

6.3 Contract

Once confirmed, a binding contract is formed between you and the Company for organisation, coordination and any guiding services we explicitly provide — and, where applicable, local partners or independent Guides involved in delivering the trip.

6.4 Third-Party Price Adjustments

If you prepay services provided by third parties (huts, transport, hotels), prices may change due to exchange rates, government fees, taxes or supplier adjustments. Any significant difference may be invoiced or refunded accordingly.

Section 07

Prices, Fees and Payment

7.1 Tour Price

The Tour Price is indicated in your quote or on the Expedition page. Unless explicitly stated otherwise, it excludes: international flights, visas, personal insurance, personal equipment, and personal expenses. The Tour Price includes our commission and commercial arrangements with local partners. We are not required to provide a detailed breakdown of internal cost structures.

7.2 Fees Overview

Booking Fee
5%

Non-refundable. Charged upon Booking confirmation. Covers administrative time, itinerary design, supplier liaison, and holding your place.

Admin Fee

Processing Fee
~2.3%

May apply for card payments depending on card type, issuing country and currency. Wise and PayPal fees may also apply.

7.3 Payment Methods

Payment may be made by bank transfer, Wise, PayPal or other approved methods. Payments are only considered received once cleared funds have reached our nominated account.

7.4 Late or Non-Payment

If you fail to pay any amount due by the specified deadline, we may treat this as a cancellation by you and apply the cancellation terms in Section 8.

Section 08

Cancellations and Changes

8.1 Cancellation by You

You may cancel your Booking by written notice (e-mail is sufficient) sent to info@nomadsofaltitude.com. The effective date of cancellation is the date we receive your e-mail.

59 – 30 days 75% refund
29 – 21 days 50% refund
20 days or fewer No refund
The Booking Fee, Admin Fee, and any payment provider fees are non-refundable in all cases, unless otherwise required by applicable law. These non-refundable amounts reflect reasonable costs incurred depending on timing.

8.2 Changes Requested by You

Any change (dates, itinerary, adding/removing participants) is subject to availability, approval by the Company and/or local partners, and any additional costs plus the Admin Fee where applicable.

8.3 Cancellation or Modification by the Company or Guide

We or the Guide may need to modify or cancel an Expedition due to:

  • Unsafe weather or objective mountain hazards
  • Injury or illness of a Guide
  • Insufficient participant numbers
  • Natural disasters, political instability, border closures or other force majeure events

In such cases, we may offer an alternative itinerary, propose new dates, or cancel the Expedition. If we cancel and no suitable alternative is accepted, we will refund the Tour Price minus any non-recoverable third-party costs — in full settlement of our liability, except where Australian Consumer Law requires otherwise.

Section 09

Traveller Responsibilities and Risk

9.1 Physical and Technical Condition

By booking an Expedition, you confirm that:

  • You are in an adequate physical and mental condition for the planned activities.
  • You meet the technical level and prerequisites indicated in the Expedition description.
  • You have informed us of any relevant medical history or condition that could affect your participation or safety.

9.2 Insurance

You are responsible for obtaining adequate travel insurance, which should typically include:

  • Rescue and evacuation (including helicopter where available)
  • Medical treatment including high-altitude and remote locations
  • Trip cancellation and interruption
  • Repatriation

We may request proof of insurance. Failure to provide proof when requested may result in cancellation of your participation without refund.

9.3 Compliance with Instructions

During the Expedition, you agree to follow all safety instructions given by the Guide or expedition leader. The Guide may modify, postpone or interrupt the itinerary if conditions, participant behaviour or other factors make continuation unsafe. No refund will be due if you refuse to follow safety instructions or choose to leave the Expedition voluntarily.

9.4 Inherent Risks

Mountaineering, climbing, trekking and high-altitude travel involve significant inherent risks, including serious injury or death. By booking and participating in an Expedition, you acknowledge and accept these risks and participate voluntarily.

Section 10

Liability

10.1 Extent of Liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, consequential or non-material damages, including loss of enjoyment, loss of opportunity, or loss of income. Our total aggregate liability is limited to the Tour Price actually paid by you for the relevant Expedition, except where consumer law requires a higher level of protection.

10.2 Third-Party Providers and Local Partners

We work with independent local operators, guides, transport companies, accommodation providers and other suppliers. We are not responsible for acts or omissions of these independent third parties, except where required by applicable travel or consumer law.

10.3 Mandatory Consumer Rights

Nothing in these Terms is intended to exclude or limit any rights you may have under Australian Consumer Law or other mandatory consumer protection laws that apply and cannot legally be excluded.

Section 11

Personal Data and Privacy

We collect and process personal data in connection with your use of the Website and your Booking — including name, contact details, passport information, emergency contact, and health information relevant to altitude and safety.

Details of how we process your data are set out in our Privacy Policy. By using the Website or making a Booking, you consent to the processing of your personal data in accordance with our Privacy Policy.

Section 12

Intellectual Property

All content on the Website (text, images, logos, graphics, videos, design and layout) is owned by or licensed to the Company and protected by copyright and intellectual property laws. You may not copy, reproduce or distribute any part of the Website without our prior written consent, except for personal, non-commercial use.

If you submit content (reviews, photos, testimonials), you grant the Company a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and publish that content for promotional and commercial purposes, unless you explicitly request otherwise in writing.

Section 13

Changes to These Terms

We may update these Terms from time to time. The updated version will be published on the Website with a new "Last updated" date. By continuing to use the Website or our Services after changes have been posted, you agree to be bound by the updated Terms.

Section 14

Governing Law

These Terms and any dispute or claim arising out of or in connection with them, the Website or any Expedition shall be governed by and construed in accordance with the laws of New South Wales, Australia. The courts of New South Wales shall have exclusive jurisdiction, except where mandatory consumer law in your country of residence provides otherwise.
